Everyday Cannabis operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Everyday Cannabis is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (these “Terms”), describe your rights and responsibilities when you use the Services.

We do not warrant that any product's appearance, performance, or quality will meet your expectations or match the depiction on our website. All product descriptions and pricing are subject to change at any time without notice. We may discontinue any product at any time and may limit quantities offered to any person, household, or jurisdiction.
SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase. Everyday Cannabis reserves the right to accept or decline your order at our sole discretion. Your order is not accepted until we confirm acceptance. Payment must be received and processed before acceptance.
We may limit or cancel quantities purchased per person, per household, per license holder, or per order—particularly with respect to hemp clones and other regulated materials.
Your purchases are subject to our Refund Policy.
You represent that your purchases are for personal or operational use—not for unauthorized resale or export.
SECTION 4 – CANNABIS & HEMP COMPLIANCE; NO MEDICAL ADVICE
Some products offered through the Services may include hemp clones, genetics, or other cannabis-related materials (“Cannabis Products”). Availability of these products is governed by federal, state, and local law.
You are solely responsible for understanding and complying with all laws, regulations, permit requirements, and licensing obligations that apply to your jurisdiction. Without limiting the foregoing:
- Hemp clone and genetics purchases are available only to properly licensed growers where required by law.
- You warrant that any license information you provide is valid, current, and accurate.
- We do not represent or warrant that any Cannabis Product is legal in your jurisdiction.
- We are not responsible for regulatory actions, seizures, holds, or denials by carriers, customs, or law enforcement.
Any statements about potential effects or uses of Cannabis Products have not been evaluated by the FDA. These products are not intended to diagnose, treat, cure, or prevent any disease. Always consult with a qualified healthcare professional before using any cannabis or hemp product.
SECTION 5 – SHIPPING AND DELIVERY
Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, inspections, weather, or events outside our control.
For live plants, hemp clones, or other perishable agricultural materials, shipping is time-sensitive and subject to environmental and regulatory factors. We are not responsible for delays, damage, holds, or confiscations by carriers or regulators, and no refunds will be issued for such events except as outlined in our Refund Policy and our Material Transfer Agreement.
Once products are transferred to the carrier, title and risk of loss pass to you, subject to any limited guarantees described on the site.
SECTION 6 – INTELLECTUAL PROPERTY
All trademarks, logos, service marks, text, images, graphics, videos, designs, and other materials used in the Services are owned by Everyday Cannabis or its licensors and protected under applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works of any part of the Services without prior written consent.
Everyday Cannabis trademarks may not be used without permission. Shopify trademarks belong to Shopify.
SECTION 7 – OPTIONAL TOOLS
We may provide access to third-party tools we do not monitor or control. These tools are provided “as is” without warranties. Your use of optional tools is entirely at your own risk.
SECTION 8 – THIRD-PARTY LINKS
The Services may contain links to third-party websites. We are not responsible for examining or evaluating their content and are not liable for any third-party materials or transactions. Review third-party policies before engaging with them.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Everyday Cannabis is powered by Shopify, but all sales are made directly between you and Everyday Cannabis. Shopify is not responsible for your purchases, and you release Shopify from all related claims.
SECTION 10 – PRIVACY POLICY
Personal information collected through the Services is governed by our Privacy Policy and may also be governed by Shopify’s Privacy Policy (https://www.shopify.com/legal/privacy/app-users).
SECTION 11 – FEEDBACK
If you submit feedback or suggestions, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, publish, and adapt such content.
SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS
We reserve the right to correct any errors, inaccuracies, or omissions and to cancel orders based on inaccurate information at any time without notice.

You agree to indemnify Everyday Cannabis and Shopify from claims arising out of your breach of these Terms or violation of law.
SECTION 18 – SEVERABILITY
If any provision is deemed unlawful or unenforceable, it will be severed and the remainder will remain in effect.
SECTION 19 – WAIVER; ENTIRE AGREEMENT
Failure to enforce a right is not a waiver. These Terms constitute the entire agreement between you and us.

You may not assign your rights under these Terms. We may assign ours without notice.
SECTION 21 – GOVERNING LAW
These Terms and any related agreements are governed by the laws of the Commonwealth of Pennsylvania. Any dispute must be brought exclusively in the state or federal courts located in Clarion County, Pennsylvania. You consent to such jurisdiction and venue.

Headings are for convenience only and do not affect interpretation.
SECTION 23 – CHANGES TO TERMS OF SERVICE
We may update or modify these Terms at any time by posting changes to this page. Material changes will be communicated as required by law. Continued use of the Services constitutes acceptance of the updated Terms.
